Terms of Service

Sections 6, 7, and 8 (End of subscription; Grandfathered legacy accounts; Trial period for new accounts) took effect on August 15, 2026. Accounts created before that date are grandfathered under Section 7.

These Terms of Service ("Terms") govern your use of the IPFS Ninja platform operated by BWS ("we", "us", or "our"). By creating an account or using the service, you agree to be bound by these Terms. If you do not agree, do not use the service.

1. Service Description

IPFS Ninja is a managed file storage service that enables users to upload files to the InterPlanetary File System (IPFS) via a REST API and web interface. Each uploaded file receives a permanent content identifier (CID) and is accessible through public IPFS gateways.

The service includes: file upload and pinning, file listing and retrieval, API key management, user authentication, and subscription management.

2. Account Registration

You must create an account to use the service. You may register with an email address and password, or via Google or GitHub authentication. You agree to:

  • Provide accurate and complete registration information
  • Keep your login credentials and API keys secure
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to use IPFS Ninja to:

  • Upload, store, or distribute content that is illegal, infringing, defamatory, obscene, or harmful
  • Distribute malware, viruses, or any destructive code
  • Violate any applicable law, regulation, or third-party rights including intellectual property rights
  • Attempt to gain unauthorized access to the service, other accounts, or underlying infrastructure
  • Use the service to send unsolicited communications or spam
  • Interfere with or disrupt the service or its infrastructure
  • Circumvent storage limits, rate limits, or other usage restrictions
  • Resell or redistribute the service without our written consent

4. Content Responsibility

Your content. You retain ownership of all content you upload. By uploading content, you grant BWS a non-exclusive, worldwide license to store, pin, and serve your content through the IPFS network and our gateways for the purpose of providing the service.

Your responsibility. You are solely responsible for all content you upload. BWS does not monitor, review, or endorse user-uploaded content. You represent and warrant that you have all necessary rights to upload and distribute your content.

IPFS network distribution. You acknowledge and understand that content uploaded to IPFS is distributed across a decentralized peer-to-peer network. Once pinned, content may be cached, replicated, or redistributed by third-party IPFS nodes. BWS cannot control the propagation or availability of content on the broader IPFS network.

Content removal. If you delete content from your account, we will unpin it from our IPFS nodes. However, we cannot guarantee removal from all IPFS nodes on the network. Content identified by its CID may remain accessible through other IPFS gateways or nodes indefinitely.

5. No Liability for User Content

BWS acts solely as a technology platform and infrastructure provider. We do not create, curate, endorse, or take responsibility for any content uploaded by users. To the fullest extent permitted by law:

  • BWS is not liable for any content uploaded, stored, or served through the platform
  • BWS is not liable for how third parties access, use, or redistribute content on the IPFS network
  • BWS is not liable for any damages arising from content served through IPFS gateways, whether operated by BWS or third parties
  • Users indemnify BWS against all claims, damages, and expenses arising from their uploaded content

6. Plans and Billing

Paid plans. Paid subscriptions (Bodhi, Karma, Nirvana) are billed monthly through Stripe. By subscribing, you authorize recurring charges to your payment method.

Storage limits. Each plan has a total storage allowance and a monthly bandwidth allowance published on our pricing page. Bandwidth resets on the first day of each calendar month. Exceeding your plan's storage limit prevents new uploads until you upgrade or free space; exceeding your bandwidth limit prevents further gateway retrievals until the next monthly reset.

Refunds. Subscription fees are non-refundable except where required by applicable law. The read-only and reactivation windows described in Section 7 serve as the equivalent user protection in place of pro-rated refunds.

7. End of subscription (cancellation, non-payment, or trial expiry)

Effective August 15, 2026.

When your paid subscription ends — whether through cancellation, unsuccessful payment, or expiry of a trial period — your account transitions to a read-only state at the end of the billing period (or at the end of the trial, respectively).

Read-only period (30 days). Files you have already pinned continue to be served through our public gateway. You can view your dashboard, download your content via API, and export your metadata. You cannot upload new content, create new API keys, or use new gateway or IPNS features during this window.

Content unpinning (day 30). After 30 days in the read-only state, we unpin your content from our infrastructure. Your files remain on the public IPFS network for as long as any other node continues to pin them; we do not delete them from IPFS itself (this is not technically possible).

Account preservation (day 30 through day 210). Your account record and file metadata remain in our system for an additional 180 days after unpinning. During this window you may reactivate by subscribing to any paid plan. Files still discoverable on the public IPFS network at the time of reactivation are automatically re-pinned to your account on a best-effort basis.

Account deletion (day 210). After 210 days total (30 read-only + 180 preserved) without an active subscription, your account and all associated file metadata are permanently deleted from our system. This is irreversible.

GDPR right to erasure. Requests to delete your account and personal data during the 210-day window are honoured immediately upon verified request to info@bws.ninja.

8. Grandfathered legacy accounts

Effective August 15, 2026.

Users who created an account before August 15, 2026 on our free-forever plan are grandfathered under the terms in effect at their signup. These accounts:

  • Retain their original storage, file-count, bandwidth, gateway, IPNS, and API-key allowances indefinitely
  • Are not subject to the read-only, unpinning, or deletion timeline described in Section 7
  • May be transitioned to a paid subscription at any time, with all files preserved

Grandfathered status is tied to the original account. It does not carry over to new accounts created by the same person.

9. Trial period for new accounts

Effective August 15, 2026.

Accounts created on or after August 15, 2026 begin with a 7-day trial that includes full access to the Bodhi plan's features and limits, at no cost and with no credit card required.

During the trial you may upload, pin, share, and manage content up to the Bodhi limits published on our pricing page. At the end of the 7-day trial, your account transitions per Section 7 above unless you have subscribed to a paid plan (Bodhi, Karma, or Nirvana).

The trial period may be limited to one trial per person. We reserve the right to decline additional trial accounts to any person or organization we determine has already used a trial.

10. API Access

We provide API access for programmatic file management. API keys are issued per account and must be kept confidential. You are responsible for all API activity performed with your keys. We reserve the right to rate-limit or revoke API access to prevent abuse or protect service stability.

11. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The service is provided on an "as is" and "as available" basis. We may perform scheduled maintenance, and unplanned outages may occur. We are not liable for any data loss or interruption of service.

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY FILES WILL BE PERMANENTLY AVAILABLE ON THE IPFS NETWORK.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BWS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, WHETHER IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO BWS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless BWS and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including legal fees) arising from:

  • Your use of the service
  • Content you upload or distribute through the service
  • Your violation of these Terms
  • Your violation of any applicable law or third-party rights

15. Copyright and Takedown

If you believe content hosted on IPFS Ninja infringes your copyright or intellectual property rights, please contact us at info@bws.ninja with:

  • A description of the copyrighted work
  • The CID or URL of the infringing content
  • Your contact information
  • A statement of good faith belief that the use is unauthorized

We will unpin infringing content from our nodes upon valid request, but cannot remove content from the broader IPFS network.

16. Termination

We may suspend or terminate your access to the service at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users or the service, or for any other reason at our sole discretion. Upon termination, your right to use the service ceases immediately. Content already distributed on the IPFS network may remain accessible.

17. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised date. Your continued use of the service after changes constitutes acceptance. If you disagree with the updated Terms, you must stop using the service and delete your account.

18. Governing Law

These Terms are governed by and construed in accordance with applicable international law. Any disputes arising from these Terms or the service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration.
